A PROCESS THAT WORKS FOR YOU
We customize our Alternative Dispute Resolution methods to fit your unique case.
Jane Binder has worked with hundreds of Minnesota couples and families to help them voluntarily and confidentially resolve legal problems and avoid going to court. Her successes have fine-tuned her approach so she can best understand parties’ needs, find creative solutions, and save them money.
Alternative Dispute Resolution Methods
-
Mediation
A confidential process in which Jane, as a neutral party, facilitates communication between the parties to promote settlement. This process is usually less expensive and less time consuming than going to trial.
-
Moderated Settlement Conference
A late-stage settlement conference which Jane facilitates. It usually occurs just before the parties have a formal trial, and often at the courthouse. A Moderated Settlement Conference gives parties a final opportunity to settle their case and avoid the expense and uncertainty of a trial.
-
Arbitration
A process in which Jane (rather than a judge) hears evidence and renders a legally binding decision resolving the parties’ disputes.
-
Consensual Special Magistrate
This process is an alternative to trial by a judge or referee. To use a Consensual Special Magistrate (CSM), the parties must agree to use that process and the Court appoints the CSM. In this process, Jane serves in place of a judge, overseeing a motion or trial on the contested issues, and issuing a binding decision, which can be appealed to the Minnesota Court of Appeals.
“Jane’s professionalism, her knowledge of legal strategy, her team’s ability to translate a complex situation into an executable plan and, yes, her compassion, helped us successfully navigate through a challenging but necessary family transition.”
